Studien zur Sprachlosigkeit im verfassten Rechtsstaat 135–150 (Vogel ed., 2017) … DOI: 10.3790/978-3-428-55247-4 One of the leading schools of jurisprudence in the United States calls itself “textualism” and celebrates its preference for “the language and structure of the law whenever possible over its legislative history and imputed values”. But does that not imply an overly naïve objectivist misconstrual of language? Maybe not. The current contribution introduces to German readers one of the most prominent manifestos of US textualism, in its first ever German translation. Its author, former law professor and current federal judge Frank H. Easterbrook, spells out his conception of how so-called textualism fosters modesty on the part of judges, and enhances effective democratic control of the judicial process – without at the same time embracing an anachronistically pre-modern linguistic worldview. The propositions of his text are as timely today as they where upon publication twenty-odd years ago, and hold out an invitation for a fruitful discourse across the Atlantic, which will be taken up by a German lawyer in the subsequent contribution in this volume.
